WELCOME to josannemark.com This website is operated by Josanne Mark Atelier Ltd. otherwise referred to as Josanne Mark Ltd. and Josanne Mark. Throughout the site and in our written correspondence (including, but not limited to, emails, newsletters and invoices) the terms “we”, “us”, “our”, "Josanne Mark Ltd." and "Josanne Mark" refer to Josanne Mark Atelier Ltd. Josanne Mark offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. 

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms of use”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

 

Refund/Return Policy:

We hope you are happy with your piece. However, in case you want to return, Josanne Mark Ltd. accepts them for exchanges or STORE CREDIT ONLY, within 14 days of receipt of goods. Store credit will be valid for one year. We do not provide refunds. To return an item, please email sales@josannemark.com for a return authorization (RA) code and return address information. Returns shipped without an RA code will be returned to sender at their expense. All shipping, handling and expediting charges are non-refundable. We reserve the right to refuse a return and items must be returned in the condition received in its original packaging. Any returned items that are damaged, altered, or show signs of wear will not be accepted for return and will be returned to the customer. Josanne Mark Ltd. is not responsible for any loss or damage incurred on return shipments. ALL SALE, CUSTOM AND SEMI CUSTOM PIECES (INCLUDING OUR FOREVER WITH YOU SERIES) ARE FINAL SALE.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state, province of country of residence, or that you are the age of majority in your state, province or country of residence. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

PRIVACY STATEMENT

SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?
When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address. 
When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.
Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.

How do you get my consent?
When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

How do I withdraw my consent?

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

SECTION 4 - Ecwid
Our shopping cart is provided by ecwid.com. They provide us with the online e-commerce platform that allows us to sell our products and services to you. 
Your data is stored through Ecwid’s data storage, databases and the general Ecwid application. They store your data on a secure server behind a firewall.

Payment:

Section 5- THIRD-PARTY SERVICES

Your payment is securely processed by a third party service; 2Checkout (which is now Verifone) and/or PayPal. In general, the third-party provider/providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.  
However, certain third-party service providers, such as our currently used payment gateway (Verifone/Paypal) and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.
For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.  
In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.

 

Section 10 - Ordering Products and Services

You must be the age of consent or older in your state, province or country of residence, and have a valid credit card, with full authority to use it, to submit an order for products or services through our Site.

Our store uses Google Analytics to help us learn about who visits our site and what pages are being looked at.

Section 12 – Shipping

All International orders are currently shipped, insured, via FedEx Courrier Service. Orders within Trinidad and Tobago are currently shipped via UPS

Josanne Mark Ltd, in conjunction with our service providers, will attempt to deliver a product within the requested range of days provided at the time the order was placed. We will send you an e-mail notification when your item is shipped, along with a tracking number whereby you can track your shipment in real time. You acknowledge that delivery date estimates are non-binding estimates only and that you have no claim against us for any delays or early deliveries and we cannot guarantee the time of delivery. All products are deemed accepted upon our delivery of the product to you or your designated recipient's address.

Section 13 - Duties and Taxes

Customs, import/export charges, or similar governmental charges are not included in the price of our products. 
Customers are responsible for all applicable duties and taxes imposed by their government and are required to pay the carrier for these charges upon delivery. If, for any reason, you refuse to accept the charges you will be responsible for the return cost to Josanne Mark Ltd. This will be deducted from the original cost of the item/items purchased and you will receive STORE CREDIT for the remaining balance. Store credit is valid for one year. (Please refer to our Refund/Return Policy above).
